These terms and conditions outline the rules and regulations for the use of sublimationmalaysia’s Website and services. By accessing this website and/or placing an order via WhatsApp or our online store, we assume you accept these terms and conditions in full.
1. General Conditions
1.1. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.
1.2. We reserve the right to refuse service to anyone for any reason at any time.
1.3. You understand that your content (excluding credit card information), may be transferred unencrypted and involve transmissions over various networks.
2. Customization & Production (Sublimation Process)
2.1. Design Approval: For custom orders, customers are responsible for reviewing and approving all artwork, spelling, and design placements. Once the design is approved by the customer, sublimationmalaysia will not be held liable for any errors found thereafter.
2.2. Color Variation: Please note that colors on a computer/phone screen may vary slightly from the actual printed fabric due to screen calibration and the sublimation heating process. A variance of 10% - 15% in color tone is considered acceptable and not a defect.
2.3. Sizing: Customers must refer to our provided Size Chart. We will not be responsible for any wrong sizes ordered by the customer.
3. Pricing & Payment
3.1. All prices are quoted in Ringgit Malaysia (RM).
3.2. For custom bulk orders, a 50% or 100% deposit (as agreed upon) is required before production begins.
3.3. Full payment must be cleared before the order is dispatched for delivery.
4. Shipping & Delivery
4.1. Delivery dates provided are estimates only. While we strive to meet deadlines, sublimationmalaysia is not liable for delays caused by courier services, raw material shortages, or unforeseen circumstances (Force Majeure).
4.2. Risk of loss or damage to the goods passes to the customer once the item is handed over to the courier service.
4.3. Any claims for damage during transit must be reported to the courier service provider.
5. Return & Refund Policy
5.1. Custom Goods: Due to the personalized nature of sublimated products, all custom-made items are non-refundable and non-exchangeable unless there is a clear manufacturing defect or a mistake made by our production team.
5.2. Defective Items: Any claims for manufacturing defects must be made within 3 days of receiving the goods. The items must be in their original, unwashed, and unworn condition.
5.3. If a defect is verified, sublimationmalaysia will either offer a reprint or a partial/full refund at our discretion.
6. Intellectual Property
6.1. The customer warrants that they own the rights to any logos, trademarks, or designs provided to sublimationmalaysia for printing.
6.2. sublimationmalaysia reserves the right to use photos of completed products for marketing and promotional purposes on our website and social media, unless otherwise requested by the customer in writing.
7. Limitation of Liability
7.1. sublimationmalaysia shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or the inability to meet a specific deadline due to third-party factors.
8. Governing Law
8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
